Client Responsibilities and Liabilities: The client is fully responsible for ensuring that all material (text, multimedia, images, and videos) on their website or mobile app is backed up before entrusting us with their project. Nubiz Solutions accepts no responsibility for data loss or damage under any circumstances. While we will do our best to meet all contract deadlines, there may be times when we need to extend or adjust time due to unavoidable circumstances such as deployment issues, hosting server issues, 3rd-Party support, development bottlenecks, resource unavailability due to emergency, communication delays, and so on. We will not assume responsibility for any changes made to your website or mobile app after they have been installed/deployed by the Client or a third party. Additions, revisions, and removals are examples of such adjustments. Before resolving any concerns, we may request a one-time web development and mobile app development fee.
Payment terms:Nubiz Solutions accepts payments by PayPal or credit card (although we reserve the right to decline payment in any of these forms without notice). We retain the right, without limitation, to remove any payment methods at any moment and to change its rates without prior notice. If the consumer cancels the Service before it is completed, a cancellation fee may be assessed. The cost will be calculated based on the quantity of work accomplished at the time of cancellation. Non-payment of the cancellation charge and/or overdue amount will necessitate legal action.
A project is divided into stages, and work on the following stage will begin only once the previous stage has been paid in full. After the Service is completed, the website/mobile app will be posted to the client section of the server for approval. Following customer approval, the website will be posted to the target server, where it will remain. Nubiz Solutions retains the right to postpone the launch of your website or mobile app until full payment is received. All code and materials created will be transferred when the project is completed and signed off on. After final payments, the customer will be the owner of the code.
Limitations of Liability: Nubiz Solutions shall provide the Services with reasonable skill and care. However, we make no assurance and disclaim any explicit or implied warranty on the Service's availability, quality, accuracy, timeliness, completeness, performance, or fitness.
We hereby release ourselves, our employees, and/or agents from all and any liability for loss or damage caused by any inaccuracy, omission, delay, or error in the production of the website, mobile application, software application, or in the delivery of digital marketing services, whether as a result of negligence or other cause. We will not be held accountable in any way for any direct, indirect, or consequential damages in contract or tort, including loss of profit, loss or damage to property, or claims brought by third parties.
We cannot offer Service guarantees on behalf of third-party organizations and will not be held accountable for any failure in any service supplied by third-party organizations.
Service Requests/Delivery: You have the right under this Terms Agreement to request our Services via the Website by filling out our Contact Form with your information and questions. Our business consultant or salesperson will contact you to answer your questions and follow-up on the information you provided. When concluding any service, please check our proposal for that specific service. You must pay Nubiz Solutions the fees specified for each service.
Project/Service Delivery: We provide free assistance for the first month following the launch of a website or mobile app. After one month of free service, we charge based on the numerous price packages most suited to the client's needs. The scope of service only includes bug fixes and email help and does not include issues with the site architecture, rule modifications, or add-ons/enhancements.
Any Third-Party support, product, and/or service used/integrated into the site that requires license, payment, copyright, etc. is the entire responsibility and liability of the client and must be given by the client or secured by Nubiz Solutions on the client's behalf for a fee.
All code and website/app development will be transmitted upon project completion and sign-offs. After final payments, the customer will be the owner of the code. We reserve the right to publicize the completed work and use it as a reference for other potential clients. If such withholding is needed, the customer must tell Nubiz Solutions well in advance and acquire prior and proper authorization. We make every effort to cover up to three adjustments within the contract's budget; but, some changes are designated as project enhancements/add-ons and become charged; we will notify you of any such items before we begin work. Any rework or changes required by the customer after approval and/or progressing to the next step of the project process will be handled as add-on work and invoiced separately. The client must pay the amount on time, without any reductions or discounts.
Cancellation Policy: If you cancel the Service before it is completed, we have the right to charge you a cancellation fee. The cancellation fee is equivalent to the amount of work done at the time of cancellation. If the cancellation charge is not paid, legal action will be taken. Nubiz Solutions provides you a non-exclusive, limited license to access and use our Website. Please keep in mind that you may not frame or otherwise enclose the Website or any portion of it without the prior written approval of. The limited license granted herein does not include the right to: I download, change, or modify the Website or its content; (ii) use the Website or its content for any purpose other than personal use; (iii) create any derivative work
based on either the Website or its content; or (iv) use our software or take any other action that may place an undue burden on our infrastructure. If we discover any unlawful use of the Website by you, we may terminate the limited license set forth below without prior notice.
